RELEASE OF LIABILITY

As a participant in the Great Eight Disc Golf Tournament the undersigned acknowledges and agrees that:

There is a risk of injury from the activities involved in this event which include, but are not limited to, heat related illness, broken bones, or more serious injury. In addition, other unforeseen risks can and may occur.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation, and,

I willingly agree to comply with the stated and customary terms and conditions for participation. I will take all prudent precautions to safeguard myself from possible harm and,

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS the organizers of the Great Eight, Jay Pontier, (“RELEASEE”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Further, I understand and acknowledge that there currently exists a global pandemic associated with the disease COVID-19, that I am participating in this event at my own risk, that any safety precautions designed to protect against the spread of COVID-19 undertaken by the Releasees does not guarantee I will not contract COVID-19, and that, the foregoing notwithstanding, it is my specific intent to affirm my foregoing release of the Releasees with respect to any personal injury, loss, damage to property, or death I may experience from COVID-19 in connection with my participation in this event.
